The result of a recent case has made a definitive stance on time limit that an employee on sick leave must use their annual leave by when it is carried over into a new year.  To read about the case please visit http://www.employmentcasesupdate.co.uk/site.aspx?i=ed26938.  The Employment Appeals Tribunal (EAT)’s verdict means that sick workers are not required to prove they are unable to take annual leave in order to qualify for their accumulated annual leave to be carried over into an employer's next holiday year. However, the decision also puts an 18 month limit on when the accumulated leave can be taken (starting from the end of the employer's holiday year in which the annual leave was accrued.).
