The Immigration Act 2016 came into effect in May and aims to prevent the exploitation of migrant workers and control illegal working.  Those who employ illegal migrants face criminal penalties.  Three government bodies are responsible for enforcing this legislation:

  • Gangmasters Licensing Authority
  • Employment Standards Expectorate
  • HMRC

Employers are advised to make checks to ensure that they are not employing illegal migrants.  This can be done by checking workers original document that evidences a worker’s right to work in the UK and ensure it is authentic, and keep a copy of this document on file.  For more information please click here.  To view the full Immigration Act please click here.
